TERMS & CONDITIONS
Article 1 – Applicability
1.1 These Terms & Conditions apply to all offers, orders, and agreements made with The Garment Atelier.
1.2 By placing an order or accepting an offer, you agree to the applicability of these Terms & Conditions.
1.3 Deviations from these Terms & Conditions are only valid if expressly agreed upon in writing. All other provisions remain fully applicable.
1.4 Any rights and claims arising from these Terms & Conditions also apply to third parties engaged by The Garment Atelier.
Article 2 – Offers and Agreements
2.1 An agreement is formed once your order has been accepted by The Garment Atelier. We reserve the right to refuse orders or impose additional conditions unless explicitly stated otherwise.
2.2 If an order cannot be accepted, you will be notified within five (5) business days after receipt of the order.
Article 3 – Prices and Payments
3.1 All prices are listed in euros. As we sell pre-owned items, VAT may be applied according to applicable regulations. Import duties and taxes are the responsibility of the customer.
3.2 Payments can be made via the payment methods offered at checkout, including iDEAL, PayPal, and bank transfer.
3.3 If payment is not received within the specified timeframe, The Garment Atelier reserves the right to cancel the order.
Article 4 – Shipping, Delivery & Returns
4.1 We ship worldwide. Shipping costs are clearly communicated during checkout and depend on destination and order value. All shipments are fully insured.
4.2 Orders are dispatched within 1–2 business days after receipt of payment, unless stated otherwise.
4.3 Estimated delivery times are indicative and depend on the shipping carrier. Delays caused by carriers or customs authorities are beyond our control.
4.4 Once your order has been shipped, you will receive tracking details. Any customs duties, taxes, or import fees for shipments outside the EU are the responsibility of the customer.
4.5 If an ordered item is unavailable, we will contact you as soon as possible. Orders placed during weekends or public holidays are processed on the next business day.
Article 5 – Retention of Title & Risk
5.1 Ownership of delivered products transfers to the customer only after full payment has been received.
5.2 The risk of loss or damage passes to the customer at the moment the order is delivered to the shipping address provided.
Article 6 – Intellectual Property
6.1 All intellectual property rights relating to products, images, texts, and other materials provided by The Garment Atelier remain our exclusive property.
6.2 Unauthorized use, reproduction, or distribution of content from this website is strictly prohibited.
Article 7 – Authenticity Guarantee
7.1 The Garment Atelier guarantees that all items sold are authentic. Each item is carefully inspected prior to sale.
7.2 If you have concerns regarding the authenticity of an item, please contact us. Authentication by a third party may be arranged at the customer’s expense.
Article 8 – Force Majeure
8.1 The Garment Atelier shall not be held liable for delays or failure to fulfill obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, transport disruptions, or government measures.
8.2 In such cases, we reserve the right to suspend or terminate the agreement without obligation to compensate damages.
Article 9 – Miscellaneous
9.1 The Garment Atelier may use third parties in the execution of orders.
9.2 If one or more provisions of these Terms & Conditions are found to be invalid, the remaining provisions shall remain in full force.
9.3 Failure to enforce any provision does not constitute a waiver of rights.
Article 10 – Governing Law & Jurisdiction
10.1 These Terms & Conditions are governed exclusively by Dutch law.
10.2 Any disputes arising from agreements with The Garment Atelier shall be submitted exclusively to the competent court in the Netherlands.
Article 11 – Copyright
11.1 All images, texts, and downloadable materials on this website are protected by copyright. Reproduction or distribution without prior written consent is strictly prohibited.
